Terms and Conditions
The following describes the terms on which tBogs offers you use of our services.
These terms and conditions apply to any of the services available from the domain and
any sub-domains of http://www.tbogs.com/ and http://www.tbogs.co.uk/, The contract
is with tBogs Ltd, 81 Leonard Street, London, EC2A 4QS
You may use our services only by agreeing to the following terms and conditions, which
are effective from 1 January 2009.
Using tBogs
You are not allowed to use the site if you under the age of eighteen or unable to agree
to legally binding contracts.
While using the Site, you will not:

breach any laws

sell any counterfeit items

infringe copyright of others

infringe trade marks or rights of other parties

fail to pay for items purchased by you

fail to deliver items purchased from you, unless the buyer fails to pay

transfer your tBogs account to another party

use in any way tBogs trade mark or any content from the site
Purpose
The purpose of the site is to provide a shop front for designers and makers of jewellery
so that they can sell their manufactured pieces and in this respect the following applies:
you are not able to cancel this agreement unless mutually agreed between yourself and tBogs.
The site is a community site and in this respect we reserve the right to terminate our
services to you without limitation if we believe you are exposing tBogs or other users
to financial loss or legal liabilities. In addition this will also apply if we are unable to
verify information that you provide to tBogs. In this respect you agree not to hold tBogs
responsible for any loss or damages you may incur as a result of tBogs terminating our
services to you.
The site is established as a community and we insist on a high level of respect amongst
our members. tBogs will not sell or indeed give to any third party information about its
clients/customers including but without limitation e-mail addresses. Any information set
as emails between buyers or sellers that go through tBogs systems will not be stored for
any marketing purposes.
You are expressly forbidden to send unsolicited, marketing or spam email through tBogs
communications systems. In addition you agree to abide by applicable laws such as data
protection and agree that the use of tBogs email system will only be used in relation to
services offered by tBogs.
Unless otherwise stated, all fees are payable in GB pounds sterling. You are responsible
for paying all fees and applicable taxes (including any value added tax) associated with
using the Site in a timely manner with a valid payment method. If your payment method fails
or your account is overdue, we may collect fees owed using other collection mechanisms.
(This includes, without limitation, charging other payment methods on file with us and retaining
collection agencies and legal advisers.) You agree that we may issue you with invoices in
electronic format by e-mail.
In order that tBogs is able to display your pieces you agree to give tBogs a non exclusive,
royalty free, worldwide right to use in any way all intellectual property rights that you
have including but not limited to copyright and trade marks.
tBogs does not own and do not have possession of any items offered for sale listed in
the shop, and tBogs is not party to transactions between buyer or seller. In this respect
you do not hold tBogs responsible for any involvement in buyer/seller transactions
regardless if the transaction has been undertaken on the site. This means that tBogs are
not responsible for the delivery, quality, description, price delivery or non payment of
items. In this respect the purchase payment is a contract limited to the buyer and the
seller for which you do not hold tBogs responsible for.
Specifically but not limited to you will not hold tBogs responsible for:
The quality of items listed
The legality of items listed
The accuracy of the description of items listed
That a transaction between the buyer and seller will be complete
That the buyer has the ability to pay
That the seller has the ability to sell
You agree that it is your sole responsibility for the legality of your actions and the legality
of any items listed which includes but is not limited to; legal ownership of items, legal
hallmarks and descriptions of items.
tBogs is not responsible for the accuracy of information listed on its shop front and
is not responsible for ensuring the validity of information supplied to us or posted on
the site.
It is not possible for tBogs to guarantee a service to our web site as either continuous
or secure due to factors that are outside of our control. Therefore we offer no warranties
to providing an uninterrupted service or availability of our service.
tBogs (including but not limited to; directors, officers, employees and agents) are not
contractually liable to you for any business losses and includes but is not limited to;
revenue, goodwill, profits, reputation, business interruption, fraudulent activities by a
thirds party or any losses as a result of you using our site.
This agreement does not constitute a joint partnership, agency employee-employer or
franchisor-franchisee relationship.
A person who is not a party to this agreement has no rights to enforce this agreement.
